The use of mediationis growingas an effective and business friendly tool to resolvemany domestic and cross-border disputes. Mediation is increasingly seen as a disputere solution option to enhance negotiation, instead of seeing it as an alternativeto arbitration or litigation. Accordingly, mediationis often incorporatedas part ofa tiereddisputeresolutionprocessthat starts with mediation (frequently as complement to negotiation) and continues with arbitrationor litigationfor those disputesthat could not settle earlier.
