Examines the extent to which the courts have been prepared to take account of a party's expressed or implied intentions or wishes with regard to a property to determine if they were in "actual occupation" within the meaning of the Land Registration Act 2002 Sch.3 para.2. Considers how objective and subjective criteria have been balanced in this decision-making.
