To Pierce or Not to Pierce? A Doctrinal Reappraisal of Judicial Responses to Improper Exploitation of the Corporate Form

It is argued, through analysis of judicial responses towards unconscionable exploitation of separate legal personality, that most, if not all, relevant cases can and should be resolved through avenues which involve neither veil-piercing nor the imposition of agency or trust relationships arising specifically to counter misuse of the corporate form.
